Welcome to the official website of EverJade Jewellery, found at www.everjade.co.za, including all related sites managed by EverJade Jewellery Pty Ltd (collectively referred to as ‘the Site’). We ask that you carefully review the following Terms and Conditions (‘Terms’) before using our Site. 

By visiting or using the Site, you agree to be bound by these Terms. These Terms govern your interaction with the Site, including any purchases made through it, and establish a binding agreement between you and EverJade Jewellery. 

EverJade Jewellery reserves the right to update or modify these Terms or any related policies at any time. Such changes will take effect immediately upon being posted. Your continued use of the Site following any changes indicates your acceptance of the updated Terms. 

If you do not agree to these Terms, we kindly ask that you discontinue your use of the Site.

 

Customer Legal Rights 

When you purchase products or services from EverJade Jewellery, you are protected by guarantees under South Africa Consumer Law. These laws ensure that all our products are of acceptable quality, suitable for their intended purpose, and accurately described. 

In the event of a major failure with any of our goods or services, you have the right to a replacement or a refund for any other reasonably foreseeable loss or damage caused by the issue. 

If a product does not meet the standard of acceptable quality but the issue is not considered a major failure, you are entitled to have the item repaired or replaced. 

 

Information and Pricing 

Please be aware that the information and prices for our jewellery and loose stones are subject to change without prior notice. The information we provide is for reference only and does not form a binding contract. Please note that certain details, such as total carat weight (TCW), may vary depending on your finger size and can increase or decrease accordingly. 

If you act based on incorrect information, you may request the cancellation of any order placed under those circumstances. We apologise for any inconvenience this may cause. For any enquiries, feel free to reach out to our diamond and jewellery experts via our contact form. 

While we strive to ensure that the information and prices on our website, emails, SMS, social media, and private messages are accurate and up-to-date, errors may occasionally occur. This could include incorrect data or prices displayed on our Site due to system glitches or typographical mistakes. Although we work diligently to prevent such errors, they may happen. 

EverJade Jewellery reserves the right to adjust prices for products at any time without prior notice. All prices are quoted in your local currency or USD. Please be aware that local taxes and duties may apply to your order. 

Please note that our prices are non-negotiable and are final.

 

Information on Our Site 

At EverJade Jewellery, we strive to ensure that our online catalogue is as accurate and comprehensive as possible. However, please be aware that some products may appear larger or smaller than their actual size in photographs, and colour and size may vary slightly depending on your computer monitor settings. 

Carat weights are provided as approximate equivalents for diamonds and total carat weights (TCW) do differ according to finger size, especially if the item of jewellery is a full eternity band. 


Copyright and Intellectual Property 

The Site and all its content—including but not limited to the EverJade Jewellery logo, designs, text, graphics, logos, button icons, videos, audio files, and software (collectively referred to as ‘Content’)—are protected by intellectual property rights, including trademarks, trade names, service marks, and copyrights, either owned by EverJade Jewellery or used under licence. All rights related to this Content are expressly reserved. 

The EverJade Jewellery Site, its services, jewellery designs, and related products are protected by South African copyright laws and international agreements. Unless otherwise stated, all content on this Site is owned and controlled by EverJade Jewellery and may not be copied, reproduced, modified, framed, published, transmitted, or used in any manner without the prior written consent of EverJade Jewellery or the relevant rights holder. 

You may not copy, use, download, alter, frame, publish, transmit, sell, license, reproduce, create derivative works from, distribute, or display any Content or third-party materials without obtaining prior written permission from EverJade Jewellery. 

All other trademarks, registered trademarks, product names, and logos mentioned on the Site are the property of their respective owners. 


Submissions 

By providing any materials to EverJade Jewellery, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, or other original content related to our Site, products, or services, you agree that these materials are non-confidential and will become the sole property of EverJade Jewellery. 

EverJade Jewellery will hold exclusive rights, including all intellectual property rights, to these materials and may use, modify, or distribute them for any purpose, whether commercial or otherwise, without any need for acknowledgement or compensation to you. 

You also grant EverJade Jewellery, its affiliates, and sublicensees the right to use your name in connection with the submitted content if they choose. 

You confirm that: (a) you own or control all rights to the content you submit, or otherwise have the authority to provide such content; (b) the content is accurate and not misleading; and (c) the use and publication of the content will not infringe upon any rights or cause harm to any individual or entity.

 

Custom-Made Jewellery 

Please choose carefully when ordering custom-designed jewellery. As each piece is created specifically to your specifications, we cannot accept returns or offer refunds on custom-made items. 

All custom jewellery designs, images, and videos produced by EverJade Jewellery remain our intellectual property and may be used or reproduced by us as we see fit. 


Manufacturing, Prices and Shipping Policy 

At EverJade Jewellery, we endeavour to process your order within 72 hours of receipt. Typically please allow between four to six weeks for the creation of custom pieces. 

We process shipments Monday through Friday, excluding public holidays and weekends. Once your order has been confirmed and dispatched, it is under the care of the courier service. EverJade Jewellery is not liable for any issues or mistakes that occur during shipping. 

Upon receiving your package, please open it carefully. Delivery times are estimates and may be affected by delays in transit or other unforeseen factors, for which we accept no responsibility. We cannot be held responsible for any damage that happens during unpacking. 

Prices listed on the Site are in Rand and include VAT (Value Added Tax). Please note that prices may change at any time without prior notice. For local customers, residing and shipping within South Africa; a shipping fee is included in the quoted price. The shipping fee is determined by the distance to your delivery address. For orders greater than the value of R15,000.00 goods in transit insurance will be included in the quoted price. This ensures that your purchase is protected throughout the delivery process, and the cost is included in the overall shipping charge. International shipping is NOT included in the quoted price and is an additional charge. 

Ensure that your address details are accurate when placing your order. We are not responsible for incorrect address information.

Collection of Goods 

You have the option to conveniently collect your items directly from the EverJade Jewellery Studio by selecting this choice during checkout. This service is provided at no additional cost. 

Please note the following: 

●  Only the person who placed the order is authorised to collect the items unless other arrangements have been made with EverJade Jewellery. We may require you to present a form of identification at the time of collection to verify your identity as the purchaser. If requested, we may need to take a copy of your ID for fraud prevention purposes; rest assured, this will not be used for any other purpose.

●  You can pick up your items once your order has been confirmed and you receive a notification that the goods are ready for collection.

●  EverJade Jewellery reserves the right to withhold the release of goods if the above requirements are not met.

Import Duties and Taxes
Most of our shipments are sent as DDP (Delivery Duty Paid), meaning that import customs duties and taxes are covered by us. However, there are some countries where you, the purchaser or local resident, may be responsible for paying local taxes or duties, which are NOT covered by EverJade Jewellery. This is due to the fact that customs regulations in your country might not permit these charges to be billed from outside the country. We advise checking with your local customs department for information on any potential additional charges before placing your order. Refunds 

We take great pride in the craftsmanship of each piece of jewellery. As such, we do not offer refunds or returns unless the item is found to be faulty or damaged. If you have any questions about returns or exchanges, please contact us directly. 

If EverJade Jewellery is required to issue a refund under these Terms and Conditions, please note the following: 

●  EverJade Jewellery will aim to process your refund within five business days during regular business hours unless otherwise stated.

●  The refund may be issued in partial payments of ZAR 5000, depending on the processes of our merchant bank.

●  The actual time it takes for the refund to reflect in your account will depend on your financial institution’s processing times.

Overdue Payment
If a client does not respond to our request for final payment within 28 days of the item’s completion, EverJade Jewellery reserves the right to sell or repurpose the item to cover the cost of the product or service provided. This action will be taken only as a last resort. We will make every effort to provide the client with ample opportunity to settle the payment and collect the item before proceeding with such measures.

Uncollected Goods

If a client does not respond to our request for final payment within 28 days of the item’s completion, EverJade Jewellery reserves the right to sell or repurpose the item to cover the cost of the product or service provided. This action will be taken only as a last resort. We will make every effort to provide the client with ample opportunity to settle the payment and collect the item before proceeding with such measures.

 

Return and refunds of Goods 

We take great pride in the craftsmanship of each piece of jewellery. As such, we do not offer refunds or returns unless the item is found to be faulty or damaged. If you have any questions about returns or exchanges, please contact us directly. 

To be eligible for a return, products must be in unused, unworn, and undamaged condition. We cannot accept returns received after the return period of 2 weeks from the date of receipt of your parcel. It is important to ensure that returned items are securely packaged to prevent damage during transit. 

All products are returnable, except for: 

●  Bespoke Jewellery

●  Earrings (hygiene reasons)

●  Items on sale

●  Chains

●  Bracelets

Please note that we do not cover damage to chains or bracelets, as they are inherently delicate and require careful handling. Should a chain need replacement please contact EverJade Jewellery.

Upon receipt of your returned item, our jeweller will inspect the condition and verify the documentation. This process typically takes 1 to 5 business days. If the item qualifies for a return or refund due to manufacturing faults, the refund will be processed to your original payment method. 

Upon receiving your Goods, please inspect them immediately to ensure they have not been damaged during transit. If you find any damage, contact EverJade Jewellery as soon as possible. 

If there is an issue with the Goods you received, please refer to our Returns Policy, which is part of these Terms and Conditions. 

To return Goods, please follow these steps: 

  1. Contact Us: Inform us of your intention to return the item.
  2. Prepare the Item: Securely wrap the jewellery in its original packaging or a protective shipping container, using bubble wrap or a padded envelope.
  3. Include Documentation: Add a note with your contact details and the reason for the return.
  4. Shipping and Insurance: You are responsible for shipping and insurance costs. Ship the item insured, with a tracking number and proof of delivery, such as a signature upon receipt. We will confirm the delivery address.
  5. Confirm the shipping waybill and tracking details: info@everjade.co.za

Once we receive your return, EverJade Jewellery will contact you. 

Please note that we are not responsible for items lost or damaged during return shipping. 

Upon receipt of your returned item, our jeweller will inspect the condition and verify the documentation. This process typically takes 1 to 5 business days. If the item qualifies for a return or refund due to manufacturing faults, the refund will be processed to your original payment method. 

Changes in Products and Pricing 

At EverJade Jewellery, we are committed to continually updating and refining our product range to better meet the needs of our customers. As part of this ongoing process, we may occasionally discontinue certain products without prior notice. Additionally, please be aware that all pricing for our products is subject to change. 

Our prices and product availability may be adjusted due to a variety of factors, including, but not limited to, shifts in market conditions, fluctuations in currency exchange rates, changes in manufacturer pricing, or the discontinuation of products. We also reserve the right to correct any errors in advertisements or other unforeseen circumstances that may affect our pricing or product offerings. 

We appreciate your understanding and flexibility as we strive to provide you with the best possible selection and value. For the most current information regarding our products and prices, we encourage you to check our website regularly or contact us directly. 

Advertising Disclaimer and Trademarks 

We strive to ensure that all product descriptions and prices on our site are accurate and up-to-date. However, we cannot guarantee that every detail is error-free. In the event 

that a product is listed with incorrect pricing or inaccurate information due to typographical errors or inaccuracies in data provided by our suppliers and brands, we reserve the right to refuse or cancel any orders placed for such products. 

This applies even if an order has been confirmed and payment has been processed. If your order is cancelled due to an error, we will promptly issue a refund to your credit card for the amount charged. We apologize for any inconvenience this may cause. 

Should you find that you are not fully satisfied with your purchase, you are welcome to return the item in accordance with our Return Policy.
